ELECTRICAL INSPECTION AGREEMENT

Magnetic Electric LLC

This Electrical Inspection Agreement (“Agreement”) is entered into between the homeowner (“Client”) and Magnetic Electric LLC (“Inspector”) for a limited, non-invasive electrical inspection of the Client’s property.

Loose electrical connections, aging components, and failing safety devices are among the leading causes of residential electrical fires. This program is designed to identify and reduce those risks through routine inspection, testing, and documentation—helping protect your home, family, and investment.

Pricing valid for homes up to 3,500 square feet.
Homes over 3,500 square feet or with additional equipment will be quoted upon site visit.

By checking the box of agreement on the Annual Inspection Registration Form and submitting payment, Client acknowledges and agrees to the following terms:

1. Scope of Inspection

The inspection is a visual, non-invasive evaluation of readily accessible portions of the home’s electrical system at the time of the inspection.

“Readily accessible” means components that can be safely observed without:

  • Removing walls, ceilings, floors, insulation, or fixtures
  • Excavating soil
  • Disassembling equipment
  • Moving permanently installed furnishings or heavy personal property

The inspection may include, where visible and accessible:

  • Main service panel(s)
  • Subpanels
  • Visible branch wiring
  • Receptacles and switches
  • GFCI/AFCI devices (basic functional testing)
  • Visible grounding and bonding components
  • Large appliance connections
  • Safety disconnects

The inspection does not include:

  • Components inside walls, ceilings, or underground
  • Load calculations or capacity analysis
  • Code-compliance certification
  • Engineering evaluations
  • Future performance predictions
  • Latent or concealed defects
  • Municipal or AHJ-equivalent inspections

This inspection is not a warranty, guarantee, or certification of the electrical system.

2. Limitations of Inspection

Client understands and agrees that:

  • Some defects may exist that are hidden, intermittent, or not visible during a standard visual inspection.
  • Conditions may change after the inspection due to age, use, environmental factors, or third-party modifications.
  • The report reflects conditions only at the time of inspection.
  • Decisions regarding repairs, upgrades, or continued use of the electrical system are the Client’s responsibility.

3. No Repairs Included

The inspection does not include repairs, maintenance, or upgrades.

Any corrective work requested after delivery of the inspection report will be:

  • Quoted separately
  • Entirely optional
  • Subject to a separate written agreement

Client is under no obligation to use Magnetic Electric LLC for any repairs identified.

4. No Third-Party Reliance

This inspection and report are prepared solely for the Client named in this Agreement.

No other person or entity—including buyers, sellers, real estate agents, lenders, insurers, or occupants—may rely on this report. Magnetic Electric LLC owes no duty to any third party who receives or reviews it.

5. Indemnification

To the fullest extent permitted by North Carolina law, Client agrees to indemnify and hold harmless Magnetic Electric LLC from third-party claims arising from:

  • Client’s use of the inspection report, or
  • Client’s failure to act upon the inspection findings

This indemnification does not apply to claims caused by Magnetic Electric LLC’s negligence or willful misconduct.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MAGNETIC ELECTRIC LLC’S TOTAL LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF THIS INSPECTION OR REPORT SHALL BE LIMITED TO THE GREATER OF:

  • THE FEE PAID FOR THE INSPECTION, OR
  • $500.00

This limitation applies to all claims, whether based in contract, negligence, tort, or any other legal theory.

Magnetic Electric LLC shall not be liable for indirect, incidental, special, or consequential damages, including but not limited to:

  • Loss of use
  • Loss of property value
  • Loss of income
  • Business interruption
  • Emotional distress

Optional Higher Liability:
Client may request a higher liability cap by written agreement prior to the inspection and payment of an additional fee. Absent such agreement, the limitation above applies.

7. Governing Law and Venue

This Agreement shall be governed by the laws of the State of North Carolina and the State of South Carolina.

Any legal action arising from this Agreement shall be brought exclusively in the county where the inspected property is located or where Magnetic Electric LLC maintains its principal office.

8. Dispute Resolution

The parties agree to attempt in good faith to resolve any dispute through informal discussion and mediation before filing suit.

9. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

10. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions or representations. No modification shall be valid unless in writing and signed by both parties.
