TERMS AND CONDITIONS 

FOR ELECTRICAL CONTRACTING SERVICES 

 

  1. GENERAL AGREEMENT 

These Terms and Conditions (“Agreement”) constitute a legally binding contract between  Magnetic Electric LLC (“Contractor”) and the client (“Customer”), including homeowners,  general contractors, or any other party engaging the Contractor for electrical services. By hiring  the Contractor, the Customer agrees to abide by these Terms and Conditions. 

 

  1. SCOPE OF WORK 

The Contractor agrees to provide electrical services as outlined in the specific contract, estimate,  or work order. Any changes or modifications to the scope of work must be agreed upon in  writing by both parties. 

 

  1. PAYMENT TERMS 
  • Customer agrees to pay the Contractor the total amount specified in the estimate,  contract, or invoice. 
  • A deposit may be required before work begins, as specified in the contract. Progress payments may be required for larger projects. 
  • Final payment is due upon completion of work unless otherwise agreed upon in writing. Late payments may be subject to interest charges of 5% per month. 
 
  1. CUSTOMER RESPONSIBILITIES 
  • The Customer must ensure the worksite is accessible and free from obstructions that may  hinder the Contractor’s ability to perform services. 
  • The Customer is responsible for obtaining necessary permits unless otherwise specified. The Customer must provide accurate information regarding existing electrical systems  and site conditions. 
 
  1. WARRANTY 
  • The Contractor warrants that all work will be performed in a professional manner  consistent with industry standards. 
  • Workmanship is warranted for a period of 12 months from the date of beneficial use. Warranty does not cover normal wear and tear, misuse, unauthorized modifications, or  damage caused by external factors.
 
  1. LIMITATION OF LIABILITY & HOLD HARMLESS CLAUSE 
  • The Contractor shall not be liable for any indirect, incidental, or consequential damages  resulting from services provided. 
  • The Customer agrees to hold the Contractor harmless from any claims, damages, or  liabilities arising from: 
    • Unforeseen circumstances beyond the Contractor’s control, including but not  limited to acts of nature, weather delays, supplier shortages, labor strikes, or  material defects. 
    • Pre-existing conditions of the electrical system or property.
    • Damage caused by third parties or unauthorized work performed by others after  Contractor’s services are completed.
    • Any interruption or delay in service due to circumstances beyond the Contractor’s  control. 
  1. FORCE MAJEURE 

The Contractor shall not be held liable for any failure or delay in performing services due to  circumstances beyond its reasonable control, including but not limited to natural disasters,  pandemics, war, government actions, or labor disputes. In such cases, the Contractor shall be  entitled to an extension of time to complete the work.

 

  1. INSURANCE 

The Contractor carries appropriate insurance coverage, including general liability and workers’  compensation. The Customer agrees to maintain appropriate homeowner or business insurance  coverage for the project. 

 

  1. TERMINATION 
  • Either party may terminate this Agreement with written notice. 
  • If the Customer terminates the contract without cause, the Customer shall compensate the  Contractor for work completed and expenses incurred up to the termination date. The Contractor may terminate the contract if the Customer fails to make payments or  comply with these Terms and Conditions. 
 
  1. DISPUTE RESOLUTION 
  • Any disputes shall first be addressed through good faith negotiations. 
  • If a resolution is not reached, disputes shall be resolved through mediation or arbitration  in NC/SC. 
  • Legal proceedings shall be conducted under the laws of NC/SC.
 
  1. ENTIRE AGREEMENT 

This Agreement constitutes the entire understanding between the parties and supersedes any  prior agreements, whether written or verbal. Any amendments must be in writing and signed by  both parties. 

 

  1. SEVERABILITY 

If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions  shall continue in full force and effect. 

By engaging the Contractor’s services, the Customer acknowledges and agrees to these Terms  and Conditions.
